But if the action only contravened US law (in my example, maybe they didn’t include the substance in question in the EU, or maybe they only sold that product in the US. The specifics don’t matter), then their home country has nothing to prosecute them for. And they would still have a right to a fair trial in the US no?

That’s a political can of worms I won’t get into, let’s all think happy Monzo thoughts :smiley: but generally speaking, fair surely implies under the laws that apply to you, in the culture you know?

One of the reasons the US has such a high rate of convictions is their usage of consecutive sentences to scare people into plee bargaining. The plee bargain starts with ‘yes I’m guilty’ and ends with, go to jail for a nominal time instead of 500 years.

I’m veering off topic but I wanted to point out a loophole in the 13th Amendment (excellent documentary " 13th " on Netflix!! I loved it) allows them to force people in jail to work for free + lose voting rights forever.
With over 2mil in jail, long sentences for African-Americans esp even for petty crimes it’s pretty much modern slavery. Jails and the justice system in the US are just money-making entities tbh

Also most US jails have been sold off to private industry with one huge corporation controling many of them. They have occupancy clauses and local authorities pay huge penalties if they don’t supply enough inmates. The private prisons also penalise inmates more than state prisons forcing inmates to have their incarceration extended.

As interesting as this conversation is, we should remember that this thread is about “Starling Feedback”. If anyone wants to start a thread on US jurisdiction and criminal justice system in the Foyer category, that would probably be a better place for the discussion.
